Datatel Commitment to Privacy
Datatel Inc. and Datatel Communications Inc. (“Datatel,” “us”, “we” or “our”) are committed to protecting your personal information and safeguarding your privacy. We provide secure payment technology services (our “Services”) for merchants (our “Customers”) that enable their customers (“End Users”) to make secure payments online or by telephone.
This Privacy Notice (“Notice”) describes how we may collect, use, or share personal information about our Customers and their End Users, both through our Services as a service provider on behalf of our Customers, and on our website where this Notice is posted. Our Customers may also provide their own privacy notices as may be applicable.

Personal Information We Collect And How We Use It
Datatel collects two different categories of personal information:
- Personal information of our Customers or potential customers (“Customer Information”), and
- Personal information of End Users who use Services provided at the direction of our Customers (“End User Information”).
Datatel uses these two categories of personal information differently because while we have a direct relationship with our Customers and therefore may determine why and how to handle Customer Information, our relationship with End Users is indirect and based on our relationship with our Customer.
We only handle End User Information in accordance with our Customer’s instructions, and as may be required by any applicable laws or regulations.
If you are an End User who has a relationship with one of our Customers, and have a question about how your personal information is being collected, used, or shared, or would like to exercise any rights you may have with respect to your personal information, please contact our Customer directly.
We will only collect, use, and share personal information when we are satisfied that we have an appropriate legal basis to do so. Subject to consent if required by law, we may collect the following types of Personal Information as maybe relevant to your use of the Services or your communication with us:
- Identifiers (such as name, telephone number, customer number or other identifiers (related either to how to contact you when you request information, or as required for your use of our Services),
- Information protected against security breaches (such as financial account information),
- Commercial information (such as your access to our website, the services we provide to you),

How We Use Your Personal Information

Lawful Basis For Processing
As a payment service provider, we process End User personal information solely for the purpose of providing the Services consistent with our contractual obligations to our Customers.
Sources Of Personal Information
We collect personal information from the following sources:
- Information that you provide: We collect personal information that you provide to us when you become a Customer, use the Services, request support, or communicate with us. For example, if you request information through our web site, then we may request your name, contact information and other information in order to fulfil your request.
- Information collected from third parties: We may collect information about you from third parties in the course of providing our Services to you. For example, we may receive personal information such as your name and account details from our Customers as needed to offer the Services.
- Information collected through technology: When you visit our web site (or when you use our Services) we may collect certain information about your location, usage, computer or device through technology such as by cookies and when paying by telephone we may collect information by using Automatic number identification (ANI).
Data Anonymization And Aggregation
Aggregated and anonymized non-personal information may be collected by us through our web site in such a way that ensures you are not identifiable. We may use anonymized or aggregated data for statistical analysis including to analyze trends, for product development, and for risk assessments and cost analysis.
We take reasonable measures to ensure the aggregated/anonymized information cannot be associated with an individual, we will maintain and use such information only in an aggregated/anonymized form, and we will not attempt to re-identify such information except to comply with applicable law. We may disclose aggregated information about you, and information that does not identify any individual, without restriction.
How We Share Personal Information
We share your personal information in the manner and for the purposes described below:
- With banks, payment processors or third-party payment service providers to authorize and complete card payments or bank payments as required. All use of End User personal information shared for this purpose is restricted and governed by separate confidentiality and data use agreements, which have been agreed upon between these service providers and our Customers.
- With our Customers, for their purpose of recording your payments to them, when necessary.
This End User personal data is only shared for the purpose of providing our contracted service to our Customers. We do not ever sell your personal information for monetary compensation.
We may also disclose personal information about you if we believe such disclosure is necessary to comply with laws, respond to lawful requests and legal process, or to protect or defend our rights, safety or property (including to enforce our agreements, notices, and terms of use). We may disclose personal information if needed to protect the health or safety of individuals.
International Transfer And Storage Of Personal Information
Your personal information may be transferred to and stored in the United States, Canada or outside of the country in which you reside, and may be subject to different standards of data protection than your country of residence. Your personal information may also be stored in the cloud.
Consistent with the instruction provided to us from our Customer, we will take appropriate steps to ensure that transfers of personal information are in accordance with applicable laws, are carefully managed to protect your privacy rights and interests and limited to countries which are recognized as providing an adequate level of legal protection or where alternative adequate arrangements are in place to protect your privacy rights.
How We Protect And Dispose Of Personal Information
We are serious about our responsibility to protect the security and privacy of your personal information. We have implemented organizational, technical, physical and contractual security measures designed to protect the personal information you provide against accidental, unlawful or unauthorized loss, theft, access, disclosure, copying, use or modification We have taken steps to ensure that the only personnel who are granted access to your personal information are those with a business ‘need-to-know’ or whose duties reasonably require such information.

Data Retention. When we no longer need your personal information to provide the Services (or to comply with applicable legal or regulatory retention requirements), it will be securely deleted or de-identified in a manner that ensures you cannot be re-identified.
Cookies And Other Tracking Technologies

If you delete or block cookies, some features of the web site or the Services may not function properly.
Children Under 18
We do not knowingly solicit business from Customers under the age of 18. Any Customer use of the Service to collect personal information from persons under the age of 18 is subject to such Customer’s own privacy notice.

We reserve the right, in our sole discretion, to modify, update, add to, discontinue, remove or otherwise change any portion of this Notice, in whole or in part, at any time. When we amend this Notice, we will revise the “last updated” date located at the top of the document. The most current version of this Notice is available on our website and supersedes all prior versions.
Your Legal Rights
If you are an End User who uses Datatel Services when paying any of our Customers and have questions about the legal rights you may have with respect to your personal information, collected, used or shared on the behalf of our Customer, please contact our Customer directly.
If you no longer want to receive marketing-related emails from us, you may opt-out of receiving marketing-related emails by clicking the “unsubscribe” link at the bottom of any marketing email you receive from us. You may also opt-out by contacting us directly using the contact information in the “Contact Us” section below.
